Always verify property documents with the help of a lawyer before purchasing land. Most land disputes in Kerala arise from incomplete document verification.

To buy land in Kerala, you need to verify the seller's title deed (Aadharam), Thandaper extract, Encumbrance Certificate (EC) for at least 13-15 years, tax receipts, possession certificate, location sketch, and land use certificate. For the registration, both buyer and seller need Aadhaar, PAN (if value exceeds Rs. 10 lakh), and two witnesses.
Kerala land records can be checked online through the e-Rekha portal (erekha.kerala.gov.in) for survey records, Thandaper details, and digital maps. Encumbrance Certificates can be obtained online through the PEARL portal (pearl.kerala.gov.in). Tax payment status can be checked on the e-Municipality portal.
Pattayam is a title deed issued by the government for land assigned/granted to individuals under government schemes. Aadharam (Sale Deed) is a registered document recording a private transaction between a seller and buyer. Both serve as proof of ownership, but Pattayam is for government-assigned land while Aadharam is for privately purchased property.
In Kerala, stamp duty is 8% of the property value and registration fee is 2% of the property value. The calculation is based on fair value (government-assessed value) or actual transaction value, whichever is higher. Additional charges may apply for document writing and other services.
Pokkuvaravu (mutation) is the process of transferring land ownership in Village Office records from the previous owner to the new owner. It is crucial because without Pokkuvaravu, the land will still appear under the previous owner's name in government records, which can cause problems in future transactions, tax payments, and legal matters.
You can get an Encumbrance Certificate (EC) online through the PEARL portal (pearl.kerala.gov.in). Register on the portal, fill in property details (district, SRO, survey number, period), pay the fee online (Rs. 100 for up to 30 years), and download the digitally signed EC. It is legally valid and accepted by banks.
Converting agricultural land (especially paddy land/nilam) to residential use in Kerala has strict regulations under the Kerala Land Utilisation Order and the Paddy Land and Wetland Conservation Act. For regular dry land, conversion is relatively easier through the Village Office. For nilam, special permission from the Revenue Department is required, and in many cases conversion is restricted.
